Hallo Leute,
der Anbieter meines Podcasts hat gerade sämtliche Songs, die ich beim ihm hoste und hier gepodcastet habe, gelöscht.

Wir haben eine oder mehrere Ihrer Dateien aus urheberrechtlichen Gründen gelöscht.

Aus urheberrechtlichen Gründen! Ha! – da hat eher jemand keine Ahnung vom Urheberrecht und leidet darunter und lässt andere gleich mitleiden.
Obwohl sämtliche Songs unter einer Lizenz stehen, die freies Verbreiten, Kopieren etc. zulassen (wie Creative Commons BY/SA oder Licence Art Libre oder LFFI) UND obwohl ich von jedem der Urheber die ausdrückliche Erlaubnis bekommen habe, ihre Songs in diesem Rahmen zu podcasten UND obwohl die Lizenz zu jeder und die Erlaubnis der Urheber zu fast jeder Episode dazustand, hat der Anbieter (es müsste eigentlich Verbieter heißen) sich verpflichtet gefühlt sämtliche Episoden zu löschen. Mh…okay die haben Schiss, dass Ihnen die GEMA auf den Pelz rückt, aber lesen können sie doch. Z.B. Ihre eigenen AGBs:
§6 Absatz 1:“Wir sind nicht verpflichtet, die Inhalte unseres Kunden zu überprüfen.” Okay – warum schnüffelt ihr dann in meinen Daten rum??? Neugier kanns ja wohl nicht sein, sonst wäre Euch aufgefallen, dass die Daten OKAY, CLEAN, THUMBS UP, LIEB-LIEB u.s.w. sind. Mit anderen Worten ihr hättet merken müssen, dass die aus “urheberrechtlichen Gründen gelöschten” Songs von ihren Urhebern gerne zur Veröffentlichung auf dieser Seite freigegeben worden sind. Bitte in Zukunft erst fragen – dann schissen, äh schießen.”
§7 Absatz 3:“Darüber hinaus verpflichtet sich der Kunde, uns von Ansprüchen Dritter – gleich welcher Art – freizustellen, die aus der Rechtswidrigkeit von in das Internet gestellten Inhalten resultieren. Die Freistellungsverpflichtung umfasst auch die Verpflichtung, uns von Rechtsverteidigungskosten ( z. B. Gerichts- und Anwaltskosten) vollständig freizustellen.” Ja, ich habe Euch durch Anerkennung Eurer AGBs von allen Ansprüchen Dritter freigestellt. Also warum löscht Ihr dann Dateien von denen Ihr 1. behauptet Sie würden Euch nicht interessieren und für deren Veröffentlichung 2. ich, Torsten Philipp (hier sitze ich und kann nicht anders) verantwortlich bin?
Okay, ich habe dem Support meines Hosters eine Mail mit der Bitte um Wiederherstellung der Daten geschrieben und hoffe, dass diese die Daten schleunigst wiederherstellen. Bis dahin ertsmal viele Grüße, Entschuldigung für die weißen bzw. geschwärzten Stellen (Lieder) auf dieser Seite. Ich halte Euch auf dem Laufenden.

P.S. Bis dahin gibt’s erstmal ein Lied von mir zu hören: “Riding on my little scooter motorbike”. Ist nicht perfekt aber erstmal besser als nix. Ich habe es unter dem Pseudonym “Die schoenen fetzen” auf Dogmazic.net veröffentlicht und dort steht auch, warum ich dieses Lied in die Public Domain gegeben habe (bzw. geben würde, wenn das in Deutschland möglich wäre, aber das ist ein anderes Thema).

the hoster of my podcast has today deleted all songs.

For copyright reasons! HA! It rather seems as if this hoster hasn’t got a clue of copyright or has some paranoia. Or both. Although ALL of the deleted songs are under a licence that allows free distribution, copying etc. (like Creative Commons BY/SA or the Licence Art Libre or the LFFI) AND although I recieved a written permission by all the authors of all the deleted songs AND although it is obvious that this was not copyrighted material (cause I published both the free licence and the permission together with the songs), my hoster has felt the obligation to delete all episodes. Okay they are yellow because of GEMA, SACEM, BIEM, CISAC and so on, but they should be able to read. At least their own general terms and conditions:
Sec 6 subsec 1 :”We are not obligated to check the content of our customers.” So why do you sniff through my content? It can’t be curiousity otherwise you should have realized, that all content is OKAY, CLEAN, THUMBS UP, HOOTCHI-GOOTCHI… With other words: you should have realized that the songs you have deleted are songs that have been published by me because their authors wanted it this way.
Sec 7 subsec 3:“In addition the customer pledges himself to indemnify us from claims of third parties – whatever kind – that might be a result of the illegality of the published content. This indemnification includes the obligation to fully indemnify us from legal costs (e.g. court and lawyer fees).” So yes, I idemnify you as often as you want me to indemnify you, so why do you delete the files that firstly, you claim you are not interested in and secondly me and only me, Torsten Philipp, are responsible for?
So I wrote the support of my hoster a mail and asked them for undeletion. I hope they get this done quickly: For now I publish one of my own songs here: “Riding on my little scooter motorbike”. It’s not perfect but better than nothing at all. I published it under the synonym “Die schoenen fetzen” on Dogmazic.net. There you can also read more information about it.
